These Terms of Service ("Terms") govern your access to and use of the Wall Street Analyst platform at analyst.commandmodule.com ("the Platform"), operated by Wall Street Analyst ("we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Description of Service
Wall Street Analyst is a financial analytics platform that provides AI-powered stock analysis, market data visualization, portfolio tracking tools, watchlists, alerts, recommendations, and related research features. The Platform aggregates publicly available financial data and applies analytical models to help users evaluate investment opportunities.
2. Not Financial Advice
Wall Street Analyst is an informational and analytical tool only. Nothing on this Platform constitutes financial advice, investment advice, trading advice, or any other kind of professional advice.
We are not a registered investment advisor, broker-dealer, or financial planner. The analysis, recommendations, scores, ratings, and any other output provided by the Platform are generated by automated systems and AI models. They are intended for informational and educational purposes only and should not be relied upon as the sole basis for any investment decision.
All investment decisions are made at your own risk. You should consult a qualified financial advisor before making any investment. Past performance indicators, backtesting results, and model-generated projections shown on the Platform do not guarantee future results. Markets are inherently unpredictable, and you may lose some or all of your invested capital.
Wall Street Analyst does not manage money, execute trades, or have access to your brokerage accounts. We do not receive compensation for recommending specific securities.
3. Eligibility and Account Responsibilities
You must be at least 18 years old to use the Platform. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your use of the Platform complies with applicable laws
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
- Scrape, crawl, or use automated tools to extract data from the Platform without our written consent
- Attempt to reverse-engineer, decompile, or disassemble any part of the Platform
- Redistribute, resell, or commercially exploit Platform content or analysis without authorization
- Interfere with or disrupt the Platform, servers, or networks connected to the service
- Impersonate any person or entity or misrepresent your affiliation
- Use the Platform to generate content that is misleading, fraudulent, or designed to manipulate markets
5. Intellectual Property
All content on the Platform, including but not limited to text, analysis, visualizations, software, design, logos, and AI-generated outputs, is owned by or licensed to Wall Street Analyst and is protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from Platform content without our prior written consent.
Market data displayed on the Platform is sourced from third-party providers and is subject to their respective terms and restrictions.
6. Data Accuracy and Timeliness
While we strive to provide accurate and timely financial data, we do not warrant the accuracy, completeness, or timeliness of any information on the Platform. Market data may be delayed, and AI-generated analysis may contain errors or reflect outdated information.
You acknowledge that financial data and analysis are inherently subject to error and should be independently verified before being used as the basis for any decision.
7. Subscription and Billing
Certain features of the Platform may require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscription terms, pricing, and renewal policies will be presented to you before you commit to a paid plan.
We reserve the right to change pricing with reasonable notice. Refund policies, if any, will be specified at the point of purchase.
8. Limitation of Liability
To the fullest extent permitted by law, Wall Street Analyst and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. This includes, without limitation, damages for loss of profits, data, investments, or other intangible losses.
Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
You expressly acknowledge that investment decisions carry risk and that Wall Street Analyst bears no responsibility for any financial losses you incur as a result of actions taken based on information or analysis provided by the Platform.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
10. Indemnification
You agree to indemnify, defend, and hold harmless Wall Street Analyst and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.
12. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Dallas County, Texas.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
